  • Will my Green Card be revoked?

Hello everyone. I've got a question with regards to my green card that I hope everyone here can offer advice on. My sister and I have been living in Canada for years. 10+ years ago, she sponsored me for a Green card. I got the card recently and both of us are now in the US. However, she has decided she wants to move back to Canada instead. I want to know if I will lose my green card if she goes back?

Hello Blaze, if and when your sister re-locates back to Canada you personally will not lose your residency. However she will lose her permanent residency if she resides longer than 6 months and does not file a tax return with IRS. USCIS will consider that she abandoned her permanent resident status. This happened to me when I went to Ontario on business and was out of the US for 6 months.

Only citizens can petition siblings. The fact that her sister petitioned her implies that her sister is a US citizen.
