  • Waiting for removal of conditional status for over a year

I (foreign national) married my wife (US Citizen) a number of years ago and went through the I-130/I-485 process smoothly. In 2015 it came time to file I-751, and we did so within 90 days of the Permanent Residence status expiring as required. Around a month later I received notification that my conditional status was extended for one year and I was required to have my Biometrics taken again, which I did. After that I heard nothing for almost a year.

I contacted USCIS to enquire about my status, and about a month before my extension was to expire I received a RFE to prove bonafide marriage. I responded quickly (Before my extension expired) with the appropriate evidence. That was almost 3 months ago and I have not heard anything since.

I am very concerned as, though I responded to everything in time, my green card and the initial extension I received for the removal of conditional status have expired meaning I have also been unable to renew my drivers license and though I am looking to change jobs I can't because I don't have appropriate documentation.

Has anyone experienced this before? I'm not sure if I should just wait it out or if there is something I can do.

You can go into an InfoPass appointment at your local USCIS office to get an I-551 stamp, which is equivalent to the green card in every way. This will allow you to get your driver's license, and will allow you to work and/or travel in and out of the country. You don't really need that for work, however. For the I-9, you can just use your unrestricted Social Security card (as a permanent resident you are entitled to a Social Security card without the restriction text; if you still have a card with a restriction text, you should get it updated ASAP), which is a List C document, along with an ID like a driver's license or passport which is a List B document.

By now you should be eligible to file for naturalization under the 3-year rule (probably were eligible last year). If you want to naturalize, then filing for naturalization is one way to speed up your Removal of Conditions application.

This is my personal opinion and is not to be construed as legal advice.

Removal of Condition still waiting 6th months this January frm date of card expiratio

      Hi,

I am a fan of Immhelp since I started my paperworks, I always get helpful information from this site. I'm also new to this site and I'd like to ask your opinion and help about my case. I'm submitted my Form I-751 April 2017, Received a NOA1 May 2, 2017 extension of my green card for 1 year. My green card exprired last July 2017 and last January 2018 was the 6th month of my waiting period. I'm not sure If by now I need to set an info pass appointment, since when we call the hotline they said its between 6 to 8 months. My husband and I are planning to travel by the end of October this year. Your input is highly appreciated. Thank you so much!

        I-751 Re: Biometric

Hi guys, I have a question. Usually how long it takes before I received notice for Biometric Appointment?

Its already been 8 weeks after I filed my Petition to Remove Conditions on Residence but until now I didnt received any notice of appointment for my biometric.

Thanks you the help and info.

I am not a lawyer, but I have also gone through this process with my wife. My wife filed the I751 last year and has completed the biometric search. Her conditional green card expired FEb 2018. We were able to travel to Canada for a vacation using her conditional green car and the 1 year extension letter. AS someone said, you can travel with an expired card and a valid extension letter so make sure you get a new extension before leaving the country.
