  • paperwork and I think I'm missing something....

    My wife is a french citizen who has been on an H1B for 8 years. We've been married for a year and a half and want to file her I-485 for her to get her green card.
    We've completed the following forms with the following attachments.
    I-485, attached: birth certificate, wedding certificate, passport copy, h1b copy, 797A for h1b copy, G-325A, I-693
    I-864, attached: my proof of citizenship, tax return, 6 months of stubs
    I-130, attached: marriage certificate, deed to our home, prior lease showing cohabitation, joint bank statement, affidavit sworn by third party, my proof of citizenship, my prior marriage divorce papers, my G325-A

    My question are:

    Is this everything we need to file? or am I missing something?

    I believe that once the application is received she will have a temporary visa to stay and work in the US which means that we won't need to renew her H1B, is this done automatically or is there another form for this (do we need i-765 for this)? (to note her H1-B) expires in August and we'd rather go this route than trying to renew again.

    If we're missing something will USCIS request it or will they just deny the application?
    Anything else I should worry about and check before sending this?

    Generally, all applicants filing for adjustment of status to that of a lawful permanent resident must submit Form I-693 completed by a designated civil surgeon. Form I-693 is used to report results of a medical examination to USCIS. The examination is required to establish that an applicant is not inadmissible to the United States on public health grounds.

      You should file for EAD (I765) and AP (I131). They are free to file with your AOS petition. The EAD gives her a chance to work, and once you have that she can choose not to renew her H1B.
