  • about form i864 :/

    hi .
    so in my case
my uncle did the i-130 for my mother
and he did the i-864 for her and father only
we paid the visa fee for me and my brother too and filled the ds-260
what will happen when we're not covered by a i864 (me and brother) ???

will they refuse us in the interview ?? or what ??

    + our priority date is 2003 i don't know what month :/
    when we'll do the interview?(about)
we filled the ds 260 in 02/02/2017 ?

You will need another co- sponsor to have enough income to cover you and your brother.
They will send you a notcie stating that you need more income.

The petitioner must sign an Affidavit of Support for everyone who is immigrating. Is there a reason they left you out?

This is my personal opinion and is not to be construed as legal advice.

no , his income is enough and everything is okay
it's just him (he doesn't want to )

it's hard to find a co sponsor :/ (still finding)
so i'm wondering what will happen if we don't find a co sponsor :/

You don't understand. It's not about the joint sponsor(s). The petitioner must be a sponsor for all the immigrants, even if they don't have enough income for all of them. If the petition's income is insufficient, then a joint sponsor can be found to also sponsor all of the immigrants, with the joint sponsor's own household income (or two joint sponsors splitting the immigrants up among them, so one joint sponsor sponsors some of the immigrants with their own household income, and the other joint sponsor sponsors the remaining immigrants with their own household income).

If the petitioner won't sponsor you, then you cannot immigrate through this petition at all.

This is my personal opinion and is not to be construed as legal advice.
