My husband (who is American) and I (british) have been married 3 years and Plan on entering the country on the 90 day visa waiver and then adjusting our status.. we have called USCIS and had to pretend we were already in the country or they couldn't assist us with our question...We asked them if we could adjust our status after entering on the 90 day visa waiver and immediately they said yes we could, no questions asked...however if we call from the UK they can't tell you that.. and I guess when entering the country if we say that we are visiting family then we arn't lieing really are we ? anyway what I really wanted to know was because we have a child together (2 years old) who is also an american citizen will we still have to have an interview ? I've read somewhere that we wont need to have one but I'm not sure.. can anybody help ? many thanx in advance..

If your husband lives in the UK with you, the best course would be
for him to file for your immigrant visa at the US embassy in UK and you
wouldn't have to go through this "adjusting status on a visa waiver."
This is not what USCIS likes and you may run into problems since you'd
be lying at entry (your intent to adjust status is premeditated).
Having a US citizen child does not exempt you from an interview.

Yes, K3 visa. Its processing time varies with country so you have to ask the embassy. Some places K3 visa processing is about the same as immigrant visa
processing so it does not make sense. So ask before you go for it.
