    Hello, My wife is trying to sponsor her Mother for a Green Card. She doesn't have a birth certificate and we got 2 affidavits from MIL's brothers in a Indian Stamp Papers. She was born in Nagpur, Maharashtra in India. We have been trying to get a non-availability certificate from Nagpur Municipal corporation but not able to get it for a while... We were told the following as the process


    1) School leaving certificate in which DOB and Place of birth should be mentioned
    2) Death certificates of MIL's Parents
    3) Show the TC and get & Fill a application form from the municipal corporation
    3) After that we need a Advocate to file affidavit (for non-availability certificate) in court. Advocate will complete all formalities of court than court will release delivery order to Municipal Corporation office than only Non Availability of Birth certificate will be issue from Municipal corporation office. It may take couple of months time or more due to court formalities, because municipal corporation is only issuing authority.

    Unfortunately, we don't have a TC but we have SSLC Board Certificate with the date of birth which is not valid document to obtain non availability certificate. Passport, Adhar Card etc... are of no use to start the process.

    Is non-availability is mandatory document to submit for Family based GC? Are there any other way? Any thoughts or feedback on this matter is really appreciated.

    Anyone got their approval without NBAC in recent days? My MIL is born in 1940s in India...Feedback appreciated.
