  • I-864 Affadavit of Support

Is there a law that protects the sponsor who signs the Affadavit of Support form I-864 and I-134 from paying alimony to the immigrant? If so, please point me to where I can read about it.

    Thank you

I'm not sure I understand your question. If you legally married someone in the US and you legally divorced and the court granted the divorce and decreed that you pay alimony, then the answer is NO. You will have to pay spousal support.

Adrian - if I sign form I-864 to support a person from overseas, let's just say my father's immigrant wife, is there a law to protect me when they no longer are married? Am I still liable for the support? If there is can someone point me to where I can read more about it.

      Thanks

The only conditions for the Affidavit of Support obligations to end are listed in the Affidavit of Support, namely, the immigrant becomes a citizen, or accrues 40 quarters of Social Security credits, or ceases to be a permanent resident and left the US, or is given a new grant of adjustment of status, or dies.
