  • Affidavit of Support - Form I-864 questions on joint tax filer

    Hello all,

I had a question on the Affidavit of Support regarding a situation where the I make enough money to sponsor my relative, but my taxes are filed jointly. What documents would I need to submit in this scenario?

    Here are the questions:

    1. Sponsor's annual income (Part 6, Q2): What should I list in the individual annual income? (Do I put the number that I have put in the joint tax return for 2016?).
    2. Most recent income (Part 6, Q19a, b, c): What do I list in the Total Income for each Tax year? (just Sponsor's income, or the income listed in IRS which is jointly filed?). And which tax years should I include, given 2016 tax year was just filed by me.
    3. I've just filed 2016 taxes, and they probably won't be part of the tax transcript that I plan on submitting. What do I submit for the 2016 taxes?

I was thinking of submitting the following:
    - tax transcripts for the 2013, 2014 ,2015 (just filed 2016 and these may not be available)
    - my w2 for 2016
    - one I-864

Is that enough, or do I need something else?

    Appreciate the help all!

You put the current (i.e. at this moment) annual salary of your current (i.e. at this moment) job(s). Not past or future income.

You put the exact number it shows on the "total income" line (line 22 of 1040) of your tax returns for those years, no matter how you filed. Either 2016, 2015, 2014, or 2015, 2014, 2013 is okay since it's before April 15.

You can submit either the tax return transcript, or the tax return and all supporting forms including all schedules, W-2s, 1099s, etc. Since you filed jointly, if your spouse is not doing I-864A and you are not counting her income, even if you are doing the tax return transcript, you will still need to include your W-2s.

This is my personal opinion and is not to be construed as legal advice.

OK thanks. So just to clarify, do I need to include my W2 for all the three years that I'm including in the form?

If you filed jointly those years and are not counting your spouse's income for the I-864, yes.

Sorry for the questions, but hopefully this is the last one.

For the 2016 tax year, it likely won't show up on the tax transcript. Do I just attached the first couple of pages with the W2 for the 2016 tax year? The entire tax return is a lot of pages, so hopefully I don't need to install the whole thing.

Income to put down in i864

My income is salary + bonus. So for the current income level in I-864, do you put down your annual salary + bonus, or just the salary?

If the salary by itself is more than sufficient, I would put just the salary, as the bonus is unpredictable. If the bonus comes predictably and regularly, then maybe you can include it too.

What to include in tax filing copy with i-864

I wanted to add my 2016 copy of my tax filing. It's a long tax packet with many pages and I wanted to know which pages do I include from my 1040? Are the first two pages ok?
