    HI,

    I'm an Irish person over 21 whose father and brother are US citizens.

    I used to be a green card holder myself, but had to give it up to return to my native Ireland to study (I studied for 8 years, qualified 2 years ago).

    I'd like to re-apply for a green card, using my father as a petitioner. The issue is however, is that he thinks he may need to rescind his citizenship during the process, and I was wondering what the consequences would be. The likelihood is that he will be able to hold onto it long enough for the I-130 to be approved, but probably have to rescind it during the wait for an immigrant visa to become available (reasons are due to tax compliance).

    So my question is this, if this happened, would I be able to appeal for my brother to become a petitioner/sponsor instead, and ultimately not lose my place in the queue? Or would I have to go back to square one and start the process all over again with my brother as the sponsor (obviously the wait times for this preference category are much higher too).

    I suppose it would also be helpful to know what the wait times are like for an Irish person applying for a green card under the F1 preference category (unmarried son over 21 of a US citizen)?

    My last question is, based on the above are there any other avenues I should explore (perhaps appealing to get old green card back)?

    I would be grateful for any advice.
