  • question about the i864 for accompany

    hello
we're in a case of a visa f4 and our case is currently at the nvc
    (my mother : principal / i'm her son : accompany )

but the problem my uncle who did the case
did the i864 only for my mom(the principal) and he doesn't wrote my name on it
i don't think he will do it
what's gonna happen if my uncle doesn't want to (i'm 18 years old )

i wish if someone had the same situation or know what's gonna happen tells me before i lost my chance

you can find another relative or friend to co sponsor as long as they are US citizens or LPR.

No but the petitioner must complete an Affidavit of Support for all the immigrants, regardless of whether there are joint sponsor(s). If the petitioner won't, then they cannot immigrate on that petition, and can only be separately petitioned later by their parent once the parent enters the US.

Your uncle will need to submit another I-864 with you on it. Or you will have to wait until your parent enters the US and then files a petition for you (and then wait 1-2 years in the F2A category before a visa number becomes available).

(by the way I was assuming you were under 21. If you are over 21 or turning 21 soon, your parent's petition for you would be in F2B category which would have several more years of wait.)
