I will be attempting to re-do my I-864 for my husband's visa, which is being held by the CO in Ghana. They asked for a joint sponsor, but we haven't found one in 3 months of trying, and over 20 people asked. Our petition passed through NVC alright, with my employment income, copies of checks and an invoice list as evidence of the benefit, but with no explanation. Our attorney's do not agree to explaining it now, fearing it is technically not my income. Other legal advise on public forums believe it will qualify. It is an adoption subsidy for my minor child, which remains in place until she leaves the home as an adult. It is not means tested, and checks come in my name. The funds are not earmarked for any specific use.
Has anyone had any experience using such income source? If I resubmit my I-864 would I explain the subsidy on the last page of the form, or do so on a cover letter?
We have decided to also use the equity in my home, our only dwelling, on the same resubmitted I-864, hoping that this would give the CO a better overview of my ability to support my husband at the 125% above poverty guidelines. We are getting the house appraised Saturday.
If I get a clear enough explanation as to why I want to do this, I will show it to our attorneys and ask them to proof the draft before I send it along to my husband to send to the consulate via DHL. Otherwise I may have to risk sending it in unproofed.
Also, would he send his passport when sending the new I-864?
