Filing for Brother: US Citizen Brother or Green card holder Parents- what is best?

Hello Everyone,

I would greatly appreciate if someone can help me in this case.

I am US citizen and recently may parents came to US and became Permanenet resident. I have a brother (28 years-Unmarried) in India. He may marry in next one year. Question is- Should I file for him or My parents should file for him? Which One would be faster to proceed?

You can petition your brother in the F4 category, which currently has a wait of almost 14 years for people born in India. Your parent can petition your brother in the F2B category, which currently has a wait of 7+ for people born in India. If he marries, then the petition from the parent dies, as there is no category for married children of permanent residents. Multiple people can petition him at the same time; they do not conflict. But if he is definitely going to get married in the next few years, there is no point for your parent(s) to petition him.

Your parents applying would be faster, but only valid for unmarried children. Given that the PD for this month is Nov 2010, expect the date to come in 7 yrs., by when your brother will probably be married and hence unfit for this category. So you applying, with a wait time of ~14yrs., is the logical choice.
