  • Waiting Period of Green card via green card holder, not in US

    Hi Gurus,

    Another question;
    I read in your website that applying for a green card after marriage to a green card holder usually takes up to five year.
    I have read lawyers claiming a year or so.
    I am a little confused, Can a lawyer (apart from providing in timely manner correct forms and documents) help with the waiting period ?
    We are talking Mexico here, and I am dubious.

    Thanks !

    A lawyer cannot make it any faster or slower. Spouse of a permanent resident is in the F2A category. Each month's visa bulletin tells which priority dates (the priority date is when the petition was filed) have a visa available that month. The wait for visa numbers in this category (i.e. how far back a priority date can file that month) has been about 1.5-2 years for the last several years. You can see this by looking at each month's visa bulletin. The dates for people born in Mexico are only a few days behind that for people born everywhere else in this category.

    This is my personal opinion and is not to be construed as legal advice.
