My apologies if this is the wrong thread/group that I am posting on. I really appreciate your responses on my questions below.
I would like to get my married sister and her family to US. Please advise on what is the right course of action to take.
1. Initially she would like to visit on a Visitor's visa. I need to sponsor her Visitor visa.
2. She would like to work here which obviously requires the H1-B visa
3. Ultimately would like to become a US Citizen along with her family. I could sponsor a Family Based or she could do an Employment Based. Obviously this depends on the processing times and visas available. Further, if she wishes to work as soon as possible, the Family based GC path is a long road as we know.
Please advise what is the correct course of action that minimizes her path to GC and US Citizenship.
A. Should she visit first on a Visitor's Visa (mainly for her to experience the US culture) followed by an H1-B ?
B. Should she directly come to US on an H1-B and apply through Employment Based path?
C. Should she directly come to US on an H1-B but at the same time apply through Family Based path simultaneously so she doesn't lose time on the priority date? (Not sure how long her employer will ask her to wait before filing for GC under Employment based category) Although I see the Visa bulletin has EB2 priority dates in 2008 versus Family based priority dates for F4 category in 2002 which makes me think EB2 path is faster than the Family based path.
D. Can she do both Family Based and Employee Based path to get her priority date in for both categories so she gets her GC through whichever is faster path? I know this is a bit expensive but not sure if you are allowed to do so.
