  • Changing from F3 to F1 after divorce

    Dear all,

    My mom filed a F3 petition for me on Jan2013 after that I got divorced Sep2016. My mom sent mail twice to USCSI PO box to request update information with divorce proof on Oct2016. It has been a year since that date but we did not receive confirmation from USCIS. How can we ensure USCIS received the documents?

    The current date of F1 is Oct 2010.

    The petition is at NVC, not USCIS, so that is where you should contact to update the petition.

      Since my case is still at USCIS, should I update NVC anyway? My case status shows at below on USCIS website
      "On January 7, 2013, we received your Form I-130, Petition for Alien Relative, Receipt Number WAC139033xxxx, and sent you the receipt notice that describes how we will process your case. Please follow the instructions in the notice. If you do not receive your receipt notice by February 6, 2013, please call Customer Service at 1-800-375-5283."

        Oh sorry you mean it hasn't been approved yet? Yeah, then I guess it is at USCIS.

          It's been more than a year since the date we submitted the update documents but we did not get confirmation from USCIS and since we have 2 years to the priority date (of F1). Would you recommend us to work with an attorney?
