  • CSPA questions and confusion..!!

    I really appreciate your help..!!!

    To summarize, when NVC started processing the application the child is underage according to CSPA, i got Invoice for my parents. one of the child's name get added after a week and then it went to "follow to join".
    after week they sent an email regarding adding name and invoice number for child. we paid IV fees and files DS -230 forms but visa is not current yet.
    which usually takes 6-8 month once they start processing, by the time child might turn in to 21 year. What are the chances of the child for getting visa? so far we paid visa fees and filed Form for him.

    Priority Date: 09/09/2005
    Approval Date: 09/16/2010
    Date of Birth for child : 09/03/1991
    NVC welcome letter : 06/14/2017
    NVC Invoice letter : 07/17/2017
    DS 230 - submitted 07/31/2017

    The alien relative petition was pending for 1,833 days

    Therefore, the age-out date for the child is 9/3/91 + 21yrs + 1833days = September 10th, 2017

    That date is in the past

    Assuming the child has not already received an immigrant visa, I believe the chances she will receive an immigrant visa is zero

        But I though the age is determined as of the time a visa number became available

          I believe you are correct with respect to preference categories other than immediate relatives. OP says "for my parents", but I may have wrongly presumed that OP is the US citizen petitioner

              What is the relationship between the US citizen petitioner and your parent/parents, and what is their country of origin?

                US petitioner is a Father who filed for her daughter (F3 category - India) and her daughter's son who is going to age out.

                  US petitioner is a Father who filed petition for her daughter (F3 category - India) and daughter's son whose name has added back automatically by NVC after receiving welcome letter.
