    hello everyone, here's my situation...

    My mother lived here illegally, (she came with a tourist visa and overstayed) five years ago she went back to country of origin (peru, she was not deported, went back willingly) and I stayed here.

    I became a citizen of the USA now, and would like to bring her back.

    Should I hire a lawyer to begin the process? or is this doable on my own? I'm not sure if the fact that she was illegal here and went back to her country complicates the process or not... if anybody has had experience with a similar situation it would be nice to hear your experience, thank you so much!

    How long did she overstay (between the date on her I-94 and when she left)?

        She wants to immigrate (become a US permanent resident), right?

        Because she left the US after having accrued more than 1 year of "unlawful presence", she triggered a 10-year 9B ban. (If she had stayed in the US until you became a citizen, she would now be able to apply in the US with no problems, but anyway that's moot now.)

        If you say she left the US about 5 years ago, the ban will last for about 5 more years. She can apply for an immigrant waiver for this ban only if she can show that her US citizen or permanent resident spouse or parent will suffer "extreme hardship" if she can't be in the US. Does she have such a spouse or parent? What is the situation with your father?

          My mom does not have a parent or a spouse in the USA, only me...
          is it possible to start the process early, or should I wait until the ban is run out to immediately submit the papers? I think there isnt much else I can do, is there?

              no.. my father does not want to come back to the usa either (relationship between my parents in a bit rough at the moment, mom actually is thinking about divorce)
