Hello, I am looking to file I-130 for my mother while she is in the US. She is widowed.
She is here on a B2 visa with the I-94 expiring on Dec. 03. I just recently got my US citizenship through naturalization a few weeks ago.
She is going to split her time between me and my brother in London.
I do not plan to file for I-485 since she would like the option of leaving in Dec when the I-94 is up.
After researching as I understand that filing I-130 only (and not I-485) while she is in US does not violate her original intent of entry to US. She still want to go back.
I was looking to answer the following questions:
1 - List of documents:
Cover Letter
G-1145
Fees Check
I-130
Naturalization certificate
My Passport copy
My Birth Certificate
Her passport copy
Am I missing any other documents?
I believe I need to send I-864 once the petition has been approved?
Also in the form there are following questions that I have doubts on:
Part-4 -19 - Date of current marriage - Should I leave it blank? Since she is widowed?
20(a)-(d) - Should I leave it blank too?
21(a)-(c) & 22 - Should I leave this blank too? Since she is widowed?
Information about Beneficiary's Family - Mention my deceased father there or not? Person - 1 elder son, Person 2, younger son (me) and Person 3 (blank) or my deceased father?
46 (b) - I assume I need her current I-94 since she still in the country?
48 - What is a travel document no.? Is that the Visa no. from the passport?
Any help on these would be appreciated!
