Here's my very brief story:
Im from the UK.
Entered US on J1 in 2004 (not subject to 2 year home stay)
Married in 2005 in Chicago. i30 approved
Later that year had marital problems and we decided to separate. i485 was deemed abandoned because i did not continue with the application (didn't schedule biometrics, medical etc)
NO removal proceedings were issued
Divorced in 2006
Married in 2015 in NYC (dated for 6 years prior)
Submitted a new i485 and i130 in 2016.
USCIS mistakenly associated prior i130 from 2005 with the i485 from 2016
Gave us a RFE and we resupplied the correct, current i130
The still mixed them up and denied the i485
Official reason for denial "no i130, so no grounds for AOS"
Our lawyer advised us to refile as it would be a black hole of waiting to get them to reopen the case etc.
Re-applied Dec 2016

Interview Scheduled for Nov 2nd 2017.

Im very nervous (ok that ones not part of my story!)
Background on me:
Citation for fare evasion in NYC subway. (went through emergency exit) - Paid and have official, original stamped document from MTA.
3 moving violations in total in my car over 10 years (none above $500)
Once owed California $600 for unpaid parking tickets (all paid years ago, have receipts)
Had my wages garnished in 2007 for underpayment of taxes in CA. ($1000)
Had a bank lien placed in 2012 for underpayment of taxes in NY ($800)
had payment plans since then with the IRS and NYS tax depts.
ALL back taxes and all prior moneys owed are now FULLY paid. Received a refund these past two years.
Filed taxes jointly with my wife this year.
Have transcripts from both IRS and NYS showing zero balance.
ok, so that wasn't very short! i hope some people don't mind reading through that.
My lawyer doesn't seem too worried about these things. We have tons of evidence and pictures, we've been together almost 10 years.
my questions;
do you think i will be overly questioned about my application from 2005 / marriage from back then?
do you think my tax history will be an issue?
my 2016 i485 denial due to clerical error?
being out of status for 10 years?
the fact that i'll probably be so nervous i'll be shaking ?!
