  • petition for overage children

My father was petitioned when i was below 21, the petitioned papers push thru on 2001. I was now overage and married. Can i still use the petition paper of my father so that I can obtain a green card.

A friend has told me that I can use the child status protection act as a tool for getting a green card. Could anyone help me on my predicament. Any help would be appreciated

    Cspa

Child Status Protection Act is for a chld status. In your case since you are already married the benefits from CSPA is not any more applicable.

      Hi,
It would mean a lot for you help me find an answer for my question. My brother from the Philippines now works in the country of Qatar(middle east) so he had his mailing address changed to Qatar. It was originally Philippine address. He has been receiving his immigration letters in Qatar since. He wanted to take advantage of the Child Status Protection Act "Opt Out" bec his priority date is Jan 1997 and the current one is Dec 22, 1996 2nd Preference Category(2B). My mom just got naturalized so my brother's category now has changed automatically to 1st preference, which has 4yr backlog.

Should he send his opt out letter to U.S Embassy Manila or in Qatar?

By the way, he's in Manila right now for vacation and he'll be back in Qatar a month after.

      Thank you very much,

        Incorrect word used - OVERAGE

        Friends,

I am sorry but I think you've used an incorrect term OVERAGE CHILDREN.

        The meaning of overage:
        1. An amount, as of money or goods, that is actually on hand and exceeds the listed amount in records or books.
        2. A surplus; an excess.

In other words, these (I hope!) are not surplus children.

I am sure, you mean to say (2 words) OVER AGE (note these are two words separately used).

        Take care.
