  • Support of Affidavits or Joint Sponsorship

    Hello all,

I was looking at getting joint sponsorship to apply for my wife for the I-130 petition. I had consultations with various lawyers who all advised me differently and due to this I am a bit confused.

I asked all lawyers the same question "If I could use my parents (who are US Permanent Residents) as joint sponsors for the petition?" Two lawyers said "Yes" and one lawyer said "No", as a joint sponsor would need to be a US citizen only. They also added that I would not be able to use them for joint sponsorship because they are not making any sort of USD income.

My question is: "Can they be joint sponsors on the petition and can their (foreign income) be converted into USD to do joint sponsorship?"

US citizens or permanent residents can be joint sponsors, as long as they are domiciled in the US. Income from anywhere should be fine.

This is my personal opinion and is not to be construed as legal advice.
