marriage with GC holder

hi

I am a green card holder married with a indian citizen boy living in india doing residency in india.

he completed USMLE step1 and step2 ck.

i had already applied for I-130 in 2004 but i think it will take more time then i expected.

i am wondering that can he come here for his STEP2 CS on visitor visa?or any other visa?

can he ask for visitor visa even if i filed a petition for him?
is it illegal?

If he is planning to apply for a B1 Visa to enter US for USMLE, then moment they enter his apssort number, the visa officer will know that an immigrant visa is pending for him. Therfore he will fail to have the non-immigrant intent required for a B1 visa. Its tough for him to get any non-immigrant US visa at this stage.
