    Hello,

    I'm currently on an H1B visa and have been married to a US citizen for over a year. We're currently preparing paperwork to file for AOS. I'm planning to leave my current job and start a business within the month and my wife is unemployed. My understanding is that we need to file an i864 and I have a friend who's willing to co sponsor our application. Do we need to file the i864? and which document should the co sponsor file. Can we rely on the friend completely for financial sponsoring? what kind of documentation is required from us and from the friend?

    The petitioner (your wife) is always a sponsor and must fill out an I-864, checking "I am the petitioner". The joint sponsor (your friend) would fill out another I-864, checking "I am the only joint sponsor". Read the instructions for what is needed. But basically: proof of current income (pay stubs for the last several months), the last year's tax return, as well as the "total income" number from the last 3 years of tax returns that needs to be filled on the form.

      Thank you for your reply, do we need to send proof of citizenship for the joint sponsor? Do we need him to get us a birth certificate?

        Yes, the joint sponsor needs to send proof of US citizenship or permanent residency.
