  • Change of Embassy Jurisdiction

    Hello,

My wife I-130 was filed in September of 2017 and received Receipt within two week. I-130 is pending USCIS approval. My wife is a resident but not a citizen of a country which have a US Embassy and consulate. I-130 was filed base on her resident jurisdiction to the country she lives in. Wife now intend on going back to her home country either before or after USCIS approval of I-130. There is a US Embassy/consulate with jurisdiction over her home country.

    1) At what point in time can petitioner Notify USCIS or NVC of her change of address and change of jurisdiction of US consulate to which wife want to be processed?
    2) what supporting documents beside her home country passport does she need?
3)Can I notify USCIS while a I-130 is being processed?

    Thanks for your feedback.

Well that entirely depends on what her home country is. If you have that information to provide then there is possibly a better answer than what any of us can currently give you
This is strictly an opinion and should not be misconstrued as legal advice. The use of this information is strictly at your own risk.
