  • Marriage To Canadian

Me and my Canadian gf are planning to get married. Does anyone know what we need to fill out?
Do we need to file an I-765 AND an I-485? She currently does not have a job - how soon can she work after we get married and file the paperwork?

If she is in the US and remains in the US:

You need to file I-130 ($535; establish relationship) and I-485 ($1225 including biometric few; adjust status to permanent resident). That will get her the green card. Please read the instructions carefully there are several supporting forms (I-130A, I-864) and documents required.

Since the application takes so long, you can also file I-765 (Employment Authorization Document) and I-131 (Advance Parole) at no additional cost. These take about 3-4 months, but often takes longer than that. She can work as soon as she receives the EAD. It’s important to understand that she cannot leave the US without the AP.
