GC Process pending for Mom - Passport expiring

  • GC Process pending for Mom - Passport expiring

    Hello,

    I applied GC for my mom (Advance Parole, I130 and I485 all applied together). She received AP approval notice and waiting for the rest. Here are my questions:
    Receipt Date - Sep 14, 2017
    My mom is here in the USA - entered with her visitors visa and then we applied for GC.

    1. Can she travel to India using her AP approval notice? Plan to return in 4-6 months time
    2. If her GC is approved while she is in India, does it affect any processing at all?
    3. What if her re-entry is rejected while waiting for GC process? Will it affect her GC processing?
    4. Her India passport will expire by September 2018. If she travels to India, we plan to renew her passport. If her passport is renewed, should it be updated to USCIS?

    She needs an actual AP (I-512), not an approval notice. If she applied for EAD and AP, the EAD and AP would be on the same card (which says "serves as I-512L advance parole" on it); if she applied for AP by itself, she should have gotten 2 pieces of paper as the AP.

    Yes, it would affect it. But there isn't any real reason why she would be denied entry unless her AOS is denied.

      Thanks for the response, newacct!

      As far the AP - yes, she did receive the actual AP notice with her picture in it. We didn't apply EAD, hence she just received a paper notice for AP. It is good to know that her GC process will not be affected. Thanks for the response, again!

        Did you check with the Indian embassy in USA ? You maybe able to renew it since your GC case is pending and your Mom still in USA
