    Hi Everyone,

I'm in a pickle I really want to send my packages in i-30, I-30a, i-485 etc as soon as possible however my husband has yet to file his tax returns for the current year. He can file for it soon however he would like to claim me as a dependent which means I would need my ITIN which would take about 2 months to get to me. I don't want to waste 2 months of not sending in my application so I'm wondering what would be the best course? Can I send in the returns for last year and update at a later time or if that request the new returns will that bump me from my space and I will have to wait even longer for an interview ?

Since it's before the deadline to file 2017 tax returns, he can use 2016 tax returns as the most recent year's tax returns now, and they may request the 2017 ones later.

Also note that he can't claim you as a dependent; I think you meant you guys will file jointly.

This is my personal opinion and is not to be construed as legal advice.

Do not waste your time! If your husband made 25.000 for 2016 you can send it. Or you can also submit a letter from his employer with his position, salary and annual incomes. If you also have savings, investments, valuable property like cars or house you can include it as well. Good luck

Thanks for the reply guys. I wasn't sure because he said if I send it with last year's tax returns they may deny my request and I will have to start all over again.
I just called the USCIS cs and they said I should submit what I have and if they need further info they will contact me for it.

If something they will just send you a letter that they need more information- which in your case is taxes 2017 but the whole process would be already started. If there is something this letter from employer with incomes really works, we did so I believe it works. Good luck to you
