  • Filing an I-130 form

    Hi guys, I just want to ask about filing an I-130 form. Because I want to file for my husband.
    So my husband has a grand father in california and I am living here in Hawaii. And his grand father wanna help us for filing a petition for my husband. They get lawyer in california and ask me to send them all the documents needed, such as bcertificate, marriage certificate, my xerox copy of green card. And they said that they gonna send or email it here in hawaii uscis or whenever the district should be sent. But my question is, if the uscis person questioned me how come my papers is sent from california while I am living here in hawaii. Thank you in Advance.

    I am trying to understand what you're saying. So you are a US citizen or permanent resident and you are petitioning your husband? Where does this grandfather come in? Is your household income on your Affidavit of Support not sufficient, and thus the grandfather is acting as a joint sponsor who also fills out an additional Affidavit of Support? Or is this grandfather just hiring a lawyer for you but is otherwise not involved? (You usually don't need a lawyer, in my opinion.)

      They probably won't ask. Everyone sends the forms to Chicago. I doubt that they are checking the postal stamp to see where it was mailed from. And if they do, you tell them the truth: you used a lawyer in CA.
