  • Whan can i do ?

    Hi everyone, i came to usa last summer with work and travel program, and i got married with a women, my wife has a Green card, my wife filled documents for apply to Green card for me, and sent to uscis. My Visa extended end of october but i stayed and worked until december 25, i knew if i get married i can stay usa until get Green card, i didnt know this is wrong, i called a lawyer on december and when he told me this stauation, i left from usa and went to my country, i want to know, did i get banned from usa or not? is this gonna be problem for my application?

      First of all, what did you wife file on your behalf. Did she file so that you could adjust your status, ie did she file forms I-130, I-485, I-1765 and I-131, or did she only file formI-130.

          Whan can i do ?

          Since you were not unlawfully in the US for more than 180 days you will be fine. Once your I-130 is approved you will be put on a waiting list for green card, which could be any where btw 1-5 years. Your wife if she has been a permanent resident for 5 years or more could consider applying for citizenship, which would help your case.

            no, she is got green card last year. so, she is have to wait 4 years for citizenship.
            Do i have to do something for get green card or just wait

                    Yes they will ask, and you need to answer honestly as Newacct said, but as long as you were legally allowed to work when you were working and applied for EAD/AP and it was approved during the AOS process you shouldn't have an issue. working without authorization is a different story but based on what you have said so far I cannot tell if you have work authorization currently or not.

                        You are not going to do AOS. You will do Consular Processing abroad when the wait for visa numbers is over.

                        As I understand from what you said, you worked illegally for a period of time. There is no ban for illegal work, and thus it should not affect your Consular Processing.

                            They may or may not ask you about employment in the US. They don't have a standard set of questions that they ask. If they do, just be candid about it.
