  • Child born Internationally

    Hello,

I have 3 children who were born internationally, and have been living in their country of residence.

I am trying to bring them to the U.S. in order to live/study. Would a green card be the appropriate way to do this? If not, what would be the Visa I should be trying to pursue?

What is your status? What was your status when the children were born? If the children are not already US citizens, then immigrating to the US (i.e. becoming permanent residents, aka green card holders) would be the way for them to live in the US.

This is my personal opinion and is not to be construed as legal advice.

I am and always have been a U.S. citizen, but the children are not. They have never traveled to the U.S.

The primary goal is to bring them for school, as opposed to pursuing residency - but it sounds like the green card would enable this.

If you were a US citizen when they were born, then the children were automatically US citizens from birth, and are still US citizens, if you met the residency requirements to pass on citizenship to them at the time of their birth. You can see a summary of the requirements here. If they are already US citizens, they need to get a US passport to travel to the US, not any visa.
