  • Applying for marriage based green card while doing long distance?

Hello. My partner and I got engaged and we were in the process of getting ready for our marriage and applying for my green card. However, recently, I received a very lucrative job offer which would require me to relocate to a different city. My partner can't move due to this job. So we are trying to figure out how risky it would be to file for a marriage based green card while doing long distance? To be honest, we have done long distance before and it's not been a problem to our relationship. I am more concerned about the optics of it all (because let's be honest, that's all that matters for this process). We are currently living together now. Unfortunately, we do not have the support of our families because we are gay and we both come from conservative backgrounds (which is partially how we first bonded), so big wedding pictures is probably not going to happen. Could I get some perspective on this? Thank you.

Well, lots of factors go into this.

How long have you lived together? Having proof that you've lived together at all, and for how long, is good solid evidence of a bonafide marriage. When/if he moves for the job, keep your joint bank accounts (if any) open, and if you don't have any joint leases, insurance, purchases, or accounts together, I would suggest getting some to use as evidence for the whole process. DEFINITELY include evidence that one of you had to move due to a job, such as a letter from an employer explaining the move, the pay rate, the location of the job, etc. Visit each other and keep the plane tickets, take LOTS of photographs, have friends and family write affidavit letters to support you and your relationship. All of these things will help build your case! Believe it or not green cards do get approved even if people may not live together. If your marriage is real, and you really focus on gathering and submitting evidence, you'll be okay
