I'm trying to figure out what my options are and what the best way to proceed is. My H1B expires early August although I have time until October 15th because of recapture time. Additionally, I have travel plans for the week after my H1B expires. I'm married to a U.S. citizen but I have not started the paperwork yet -I was planning on starting the process a couple months later. Additionally, my employer had started the process of applying for an employment based green card for me - but now that I am married, I'm going to tell them to hold off on that filing.
I could start the Family Based GC process immediately and hope that I get my advance parole in time - does that seem feasible? The downside to this is that it will cost me about 5K between lawyer fees and forms which isn't that big a deal but I'd rather not have to deal with.
Is there a way I can get a new H1B visa stamped that is valid through the October 15 which is how much recapture time I have? I'm not familiar with what that process is but if that's a possibility, I could have my employer arrange for it.
Are there any other options that I am not considering?
