  • When 485 is pending can I enroll in any classes

    Hello,

I am now on F1 (OPT) with my green card is pending. I work full time under OPT's EAD.

Can I enroll in classes (degree or non-degree) while my 485 is pending???????

    Anybody knows?

Sure, you may enroll. I am guessing you are wondering if there is a way to qualify for in-state tuition. Almost every school has a way to do that. How stringent the requirements are depends upon every school. I am in Minnesota. Here is the link for the Resident Classification Appeals Form. https://admissions.tc.umn.edu/PDFs/ResidencyAppeal.pdf
Every school will have their own form. Here are the rules. Page 1. Spouses and common Households. This school has very relaxed rules. Pretty much if you're married to a US citizen who is considered a resident for tuition purposes, then you get reclassified as a resident. You have to have a valid non-immigrant visa and may not be out-of-status.The rules may be more even more relaxed at community colleges.

      All the best.
