  • Entering on B2 with pending I-130: Tips/suggestions

    Hello

I am a US citizen and applied for my mother's I-130 (consular processing in Mumbai) on 1/19/2018. The application is currently at the USCIS Texas service center, and I called them up and they told me that processing times can be expected to be in the 7.5- to 9.5 month range; the I-130 is pending.

I would like to bring my mother to the US in late May/June. She already has a multiple entry tourist visa (B2), and she was here in December last year.

I know this is risky because I-130 shows intent to immigrate and she is entering as a tourist, so my question is, what can I do to improve her chances of being approved for entry at the border?

We are not planning to do an AoS/I-485 if she gets here, instead she will fly back once her interview dates are confirmed. I understand showing ties to the home country is important. She has some family property which I have documentation for. What else should I be doing? Should I at least wait till the I-130 is approved? Any recent success stories?

    Thanks in advance!

I entered US on B2 while my I30 was in process due to birth of my child in US. They took me for second stage screening/interview at the immigration counter however for a short time only and asked few basic questions. This was one year ago.

However still as per the advise of my lawyer its very risky and should be avoided.

That's good to know, and does give me a good feeling about this. My situation also involves a baby, and the purpose of the visit is really for grandparents to see the baby.

It's definitely a risky move, I'm curious to know what more I could be doing to 'reduce' the risk even if it is by a little.
