  • Spouse & Children of US citizen application cost

    My friend is a USA Citizen that has lived her life in Mexico. She now moves to USA. In order to bring her non-citizen spouse and 2 children to USA from Mexico do she pay for 3 separate I130 application or can she pay for her spouse and include her two children with that same application. Her children are small. This will be much cheaper then 3 application.

    If the children are her biological children, and if she met the requirements to pass on US citizenship onto them at birth (cumulative 5 years of physical presence in the US in her life before the child's birth, including 2 years after she turned 14; but if the child was born out of wedlock before 2017, the requirement is instead 1 continuous year of physical presence some time in her life before the child's birth), the children are US citizens and should apply for CRBAs and US passports.

    If she didn't pass on US citizenship to them at birth, then yes, 3 separate I-130.
