  • I-130 form question

    I am a naturalized citizen and want to sponsor my widowed mom for GC/citizenship. My mom is currently in the US under temporary protected status until June 2018.
    1) In Part 4, 20-21 of I-130, do I still need to write about my deceased father and their marriage?
    2) Do I need to submit any other form besides I-130 to sponsor my mother?

    He should be listed as a prior spouse, not as a current spouse. Don't put anything in #20 as she is not currently married. In #21 list him as a prior spouse, with the date marriage ended being the date he passed away.

    Isn't she doing Adjustment of Status in the US? If so, she should file I-485, which itself has a bunch of supplementary forms needed (I-864, I-693, etc.). Also, if filing I-485, it is recommended to also file I-765 for EAD and I-131 for AP.

      Isn't she doing Adjustment of Status in the US? If so, she should file I-485, which itself has a bunch of supplementary forms needed (I-864, I-693, etc.). Also, if filing I-485, it is recommended to also file I-765 for EAD and I-131 for AP.[/QUOTE]

      Thank you so much for your advice. I basically want to change my mom's TPS status to a green card and/or citizenship. Are you saying I should not submit the I-130 form but instead file I-485?

        If she entered the US legally, you should file I-130 and I-485 together.

        Basically, I-130 is just the petition. She still either has to do Adjustment of Status in the US or Consular Processing abroad in order to get permanent residency.
