  • Understanding GC process for parents and required time of stay

    Hi,

I am a US citizen for the past few years and my parents are Indian citizens. I have finally been able to convince my parents to apply for GC since they are getting old and I would like for them to have the option to stay with us, if needed. They currently have tourist visa. I have a few questions and wondering if you can help answer them -

    1. What is the better option for them - apply through consular processing or after they come to the US on tourist visa then go ahead with adjustment of status? I have read various posts online and I am a bit confused with the pros and cons. Any thoughts on what you would do and information on estimated timelines? They are not in a rush to visit and stay with us and we want to take the most risk averse and simplest route for the process to avoid headaches.

    2. Once they receive permanent residency, if they stay outside of the US visit us once a year for 3 months, will they be able to continue applying for permanent residency every 10 years? Or is the best route for them to stay 5 years in the US and then apply for citizenship and then go back and forth as they wish. My parents would like to ideally continue living in India for foreseeable future.

Just a few other comments in case they make a difference -
    1. My income should suffice to prove that I can support them
    2. My brother is in the process of applying for GC through his job. This hopefully shouldn't impact their application hopefully but listing this info just in case it is relevant.

Really appreciate the any insight or feedback. I know it is difficult situation for a lot of immigrants such as ourselves who have a home here in the US and also want to make sure that our parents are well taken care of and this forum is extremely helpful to share knowledge and experiences.

    Thanks,
