I-864/I864A Help
U will still have to file the Affidavit of Support even if u don't qualify. If a person has the financial requirement, they can file. They do not have to live in the household, just meet the financial requirement. They are considered a joint sponsor. If there income is not enough, then the income of other household member can be used. They would be have to complete the I-864A.

Also, if husband has acquired 40 credits of work, he will not need a sponsor.

A soponsor is not required to be employed, so long as the sponsor's income from sources other that employment, or the income of other qualifying persons in the household and/or assets are sufficient to reach or exceed the povety line for the sponsor's household size.
Yes., the law requires that the petitioner must be a sponsor and file an affidavit of support, even if he or she cannot meet the income requirements. The petitioner remains fully liable, along with the joint sponsor, for any benefits the sponsored immigrant(s) my use. the joint sponsor must file a separate AOS.Last edited by dcdb; 05-29-2006, 06:21 PM.

what is time duration for I-130 process
My Husband is an american citizen. We filed my I130 in may-05 we got aproval on march 29th 2006. He has already submit I-864 last month. But after that we have not recd any reply from them.
This month one year complet of my I-130 Filing. We just wonder generally how much time they are taking after affidavit of supprot has filed.This is reaaly very depressing as we don't know about time limit.

We're at a roadblock with the I-864 since I stay home with our children and my husband is our primary source of income. Can I be his sponsor when I do not have an income? Can my husband fill out I-864A (Contract Between Sponsor and Household Member) as a joint sponsor? Or can my mom (she is American) be a joint sponsor even though she is not a "Household Member"? And would she have to fill out the I-864, or the I-864A? I was curious if anyone else has gone through a similar process and can offer any guidance/insight/help?

Seems that you're the guru on this: my wife is the USC and I'm the alien; however, I am the one making the money, though she also works. When I file for AOS, what forms do I have to fill out and how do we explain that we are using both of our incomes?
