  • Work During I-485 Pending Period

    Hi All,

Recently this question has been bugging me. I am currently working for a company using my CPT of F-1 visa. However, recently I got married and filed for I-485, together with I-765. As of a few days ago, my case was received and changed to I-485 Pending.

    Here is my question:

F-1 visa does not allow any immigration intention. That is, as soon as my I-485 status changed to pending, I lost my F-1 visa eligibility. Does that mean I lost my CPT as well? Would I be forced to leave my job?

Thank you very much! The idea of losing my job for filing I-485 is terrifying. Any insight is appreciated!

    Best of luck to all!

No. You remain in F-1 status for as long as you would have before, as long as you didn't do anything to violate F-1 status (e.g. work outside of F-1).

This is my personal opinion and is not to be construed as legal advice.
