  • Work permit for siebeling.

Hello. I would like to know what are my options for working in the US if my brother is a citizen. I'm mixed up with i-130, i-485, i-765.

    Thanks

Siblings of US citizens are in the F4 category, which has a wait for visa numbers of about 13.5 years for people born in most countries (longer for people born in India, Mexico, or the Philippines). That means you must wait until that many years after the filing of the I-130, before you can proceed to the next step, which is either Adjustment of Status (I-485) in the US if you are in the US and in status at that time, or Consular Processing abroad otherwise. Before a visa number becomes available, having a pending or approved I-130 does not give you any special ability to enter, stay in, or work in the US. It sounds like an I-130 hasn't even been filed for you, in which case it will not help you to work in the US for at least a decade.

If you are unmarried and born anywhere except Mexico, it would be faster for your sibling to petition a parent to immigrate to the US, and for that parent to petition you as an unmarried over-21 child of a permanent resident in the F2B category, which has a wait of about 7 years.

This is my personal opinion and is not to be construed as legal advice.
