    Hi everyone,

    Just received the RFIE today, apparently USCIS is saying the income didn't meet the 125% poverty guideline, and asked for more evidence.

    Here is my situation: my spouse (US citizen) is sponsoring me for marriage-based green card while he is currently in a graduate program in the university. His stipend doesn't meet the poverty guideline, so we decided to use my income (intended immigrant) combining with his as a household income. I am currently full-time employed during OPT of my F1 visa. We have submitted both of our tax return, and my W2 for last year, my employment authorization letter and his school admission/stipend letter, leasing contract indicating we are living together for more than 6 month now.

    However, we still got this RFIE asking for more supporting docs, I don't know what else we need to submit? Or have we missed anything?

    Everything is moving really fast so far, however, the RFIE might be the first hurdle...Here is my timeline:



    May 02 Documents received by Chicago Lockbox
    May 08 Check cashed
    May 10 Form 797 received for the receipt of documents
    May 18 Fingerprint appointment letter received, schedule on May 30
    May 29 RFIE received

    II?m in exactly the same situation. My biometrics is this week but I received the same notice asking for all the above and I also sent them everything you mentioned. My husband also didn?t make enough last year. What did you end up doing? Does anyone else have any advice?

      I'm in the same situation, only flipped. I'm a USC filing for my spouse. When we married & filed, I was finishing grad school & he was full-time on OPT. Since my summer jobs didn't meet the 125%, we used his income, both of our taxes, etc. We filed in Feb, did Biometrics, & he got his EAD. No RFE so far and no other movement/updates.

      I'd be interested to know how it goes for you. What did your RFE ask for?

      In addition to those docs, we submitted his employment contract stating his salary & a letter from his employer certifying that he would continue to be employed after becoming an LPR.
      2/20: Received at Chicago lockbox
      4/04: We reviewed your biometrics and are processing your case (I-765 & I-485)
      4/18: Ready to be scheduled for an interview (No notification, not updated on either site until Aug 27)
      4/19: Request to expedite EAD
      5/11: Received EAD
      6/26: Applied for Advance Parole
      8/09: Advance Parole approved
      8/29: Scheduled for Interview
      10/11: Interview
      10/12: RFE on I-130 (misplaced G28)
      10/16: Sent new G28
      10/19: Approved!
