  • Submited for GC, marriage proposal

Hi all, I may have a problem.

I submitted for GC last year and after then I proposed my GF. She said yes, and we're going to get married later this year.
Meantime I won GC in the lottery, but we're not married yet. And this is the problem Do I have to marry her before I fill D-260 if I would like GC for her as well??

    Thanks for your help

To have her immigrate as your derivative beneficiary (and not have to wait several years for her to immigrate), you have to marry before you become a permanent resident (i.e. before you enter the US with the immigrant visa), and both you and her have to get the visa before the end of the fiscal year (fiscal years begin and October and end in September). It would probably be best to marry before applying for the visa and apply together so she won't get delayed and miss the end of the fiscal year.

This is my personal opinion and is not to be construed as legal advice.

Thanks for you reply. My question is: I was notified about winning the green card just a week ago. And I don't know if I have to fill D-260 ASAP or I can do it later. After I will marry her later in September.
      I didn't find the answer
