    Hello,

    My mom was petitioned by her citizen sister using the I-130 F4. At the time of filing, she was filed as married with a child under 21 years old. However, she was recently divorced and would like to remove her ex-spouse from the petition. I was wondering if anyone has an idea of how to best approach this? Do we write a letter to NVC/USCIS? Is there a form to fill out? If we need to notify them in writing, how should it be written? Also, how, if any, would it affect the petition?

    Hi. First of all, I know nothing about anything for sure. I'm just guessing based on my experience.

    I think there's no need to do anything right now. When your mom's PD becomes current for filing, then she can just submit her and her children's application.
    Even if somehow the ex-partner tries to file for his own, he would be just rejected since you have to submit bunch of official documents to prove their relationship with a petitioner and with a direct beneficiary.
