  • Going back home to get married while in F1 visa to a GC holder

Hello i am a GC holder from Nepal, my to be wife is a F1 student here in US, she came here in Dec 2017. I knew her since she was in Nepal since 2016, and we got closer as we started living together here since she came to US. we wanted to get married and also file for her GC application. I wanted to go back home and get married, Should we do that or should we get married here in USA? is there any advantages or risks in doing one vs the other?

I would say get married here since you're both here already and get filing. You can always have a ceremony later down the line in your country to mark the fact you got married, but so that your family and friends can also be involved.

You can get married and file, but remember, spouse of GC holder has 2 years Priority Date time. so if you want her to be in the USA till her Adjustment of Status, she needs to have at least 2 years visa validity period from when you are married.
