  • Sister GC while visiting

    Hi

My sister ( widowed and has a daughter 23yrs old) is visiting the US for a couple of months.
Can I apply for her GC petition while she is here ? Will that cause any issues with her visitor visa. Her visa is for another few years.

Does applying for GC void her visitor visa? Please let me know
Thanks much for your time & insight

    appreciate it
    Good wishes

Petitioning her does not void her visa. It is irrelevant whether she is in the US or not when you petition her. After you petition her, when her petition is pending or approved, while she is waiting for the 13 or so years for a visa number to become available, there is no rule that prohibits her from visiting the US or getting visitor visas, but it's hard to say whether immigration officers or visa officers will have a greater chance of denying her, especially when it gets close to when a visa number will become available.

This is my personal opinion and is not to be construed as legal advice.
