  • Can we travel within USA and cross "internal" checkpoint? pending I-485

    Hi,

We applied for a family based green card for my wife I-485 and I-130. We have receipts for both items reflecting the applications have been received and are in process. We are needing to travel within the USA, specifically, from Dallas, TX to Brownsville, TX. However, we are worried that on our return trip they may not let my wife through the internal border patrol checkpoint. We do not have an EAD card, we only have the receipt reflecting the fees paid and the application is in process for the I-485.

Her I-94 has expired, however she is not traveling outside of the USA.

What documents are required for her return?

    Thanks!

as long as you have proof that you filed for AOS, and you are not traveling outside of the US you'll be fine, you don't need Advance parole to travel inside the United States, however be prepared to show proof if they ask. but I'm not familiar with any internal check point anywhere in between Dallas and Brownsville although it's been a bit of time since I've traveled to that part of Texas.

Yes. She has a pending I-485 which allows her to stay in the US. Just show her I-485 receipt.
