    I came to America in 2007 with a visitor visa which is now expired. My brother is a US citizen and he wants to apply a green card for me. Is it possible for me to get the green card without leaving the country?

        You would be under the F4 category if eligible

        Fourth preference (F4) - brothers and sisters of U.S. citizens (if the U.S. citizen is 21 years of age and older).

        There is a 10+ year waiting list for a visa to become available for that category depending on where you are from (the wait times for India, Mexico and the Philippines are longer).

        I believe you need to be in a legal immigration status to apply under that category.

          Thank you, If I am eligible can I apply for the Employment authorization together with the adjustment of status and my brother's petition at the same time?
