  • Change of status from H1 to Green card

    Hi,

I like this forum, very informative.
I have question, it will be great if you guys can help me.

I am in US on H1-B visa and my brother (he is US citizen) sponsored me few years’ back, when I was not in US. So is their any way his sponsorship is useful for me HERE or is it necessary for me to go back home, in order to continue the case until I get green card.

Plus one more thing he applied for sponsorship from New York and right now I m in California, does this thing matter? Because I was viewing processing dates, that are different for both states.

Thanks a lot for you time and your attention.

    1. You need to wait for your priority date to become current which actually takes around 12 years. Until then, you can do nothing. Once your priority date is current, you can either file Adjustment of Status in US or Consular Processing in India.
    Check priority date at http://www.immihelp.com/greencard/visa-bulletin.jsp

    Adj. of Status: https://www.immihelp.com/i-485-adjus...tus/index.html
    Consular Processing: /usa-immigrant-visa-process/

    2. NY or CA does not matter.
