  • going to petition (I-130) for my mother, should we also apply for employment Auth?

Hello everybody i'm naturalized citizen and i'm starting the petition for my mother who is 69years old , i also want to submit the I-765 application for her.

I want to submit the I-765 mostly because i want her to get a SSN asap so i can put her on my medical insurance.

My question is it's okay to submit the i-765 with the I-130 considering her age, or immigration may give a hard time on why we are applying for her i-765

    thanks in Advance

If your mother is in the US, you would file I-130 petition with I-485 Adjustment of Status. Along with I-485 she can apply for I-765 for EAD and I-131 for AP for free. She does not need a reason to apply for EAD or AP. Applying for EAD for seniors or children is perfectly fine.

If your mother is not in the US, you would just file the I-130 petition, and after it is approved she would go through Consular Processing at the US consulate in her home country for an immigrant visa. During this time, she does not have any special ability to enter, stay in, or work in the US.

This is my personal opinion and is not to be construed as legal advice.

You mentioned putting her on your medical insurance. The only people that are eligible to be added to your medical insurance are your dependent children and spouse so she isn't going to need the SSN for that purpose since she doesn't qualify.
