  • Mother's Green Card application Over 13months now & AP/EAD is expiring in Nov/Dec

    Hi

I had applied for my mother's (70+) GC Sept 2017. Got the AP Oct 2017.
Got a notification asking for Police clearance in Jul 2018. No other updates.

Her AP is expiring & so is her EAD. What are the forms that I should apply again ?
Can she travel during this time? Is there a renewal process for AP and EAD?

I had not checked on expiry and just noticed. She needs to travel early December, Any help appreciated

    Thanks
    Goodwishes

Paroled Status in Passport during entry - Does it override AP expiry?

      Hi
In the passport at the immigration, they have signed saying Paroled until Jul 2019.
But EAD/AP says expiry is Nov 2018.

Does she still need to apply for the Parole Visa if travel is scheduled in Dec 2018?
Also can she travel if she gets the receipt or HAS to have approval before travel?

The sign in passport that says US Dept of homeland security Paroled until Jul 2019 mean? Is she allowed to travel?

      Thanks
      Good wishes

No, she cannot travel until Advance Parole is approved. It may take 5-6 months to get Advance Parole these days. There is no way she will get it before December if she applies now, unless she applies for Emergency AP, and that is only if she has a very urgent humanitarian reason.

The admit-until date on her I-94 when she was paroled is meaningless; it's how long she's "allowed to stay" for this stay but of course she can stay as long as I-485 is pending anyway. It has no relevance to her ability to enter the US.

This is my personal opinion and is not to be construed as legal advice.

Thanks much again. uscis when i called said that thats the other option i can try. Apply , get receipt, take the receipt to Infopass appointment and request. But they may/may not consider it emergency.
It is my dad's ceremony and she would definitely want to go. my bad I didn't realize the expiry dates.
Not sure if that will be considered an urgent reason.

Nonetheless I should apply rightaway for the renewals right?
